The following is our Privacy Policy regarding how your personal information is collected, used, and shared when you visit or make a purchase from NuKixx.com.

By agreeing to, or purchasing, you thereby accept and agree to these terms and conditions, including, without limitation, your agreement to resolve any disputes with us through binding, individual-only arbitration, as detailed in the “Dispute Resolution” section below. This Agreement is limited to the Program and is not intended to modify other Terms and Conditions or Privacy Policy that may govern the relationship between you and NuKixxUSA in other contexts.

 

YOU AGREE THAT YOU SHALL INDEMNIFY, DEFEND, AND HOLD US HARMLESS FROM ANY CLAIM OR LIABILITY RESULTING FROM YOUR FAILURE TO NOTIFY US OF A CHANGE IN THE INFORMATION YOU HAVE PROVIDED, INCLUDING ANY CLAIM OR LIABILITY UNDER THE TELEPHONE CONSUMER PROTECTION ACT, 47 U.S.C. § 227, et seq., OR SIMILAR STATE AND FEDERAL LAWS, AND ANY REGULATIONS PROMULGATED THEREUNDER RESULTING FROM US ATTEMPTING TO CONTACT YOU AT THE MOBILE TELEPHONE NUMBER YOU PROVIDED.

 

 

Age Restriction:

You may not use or engage with the Platform (NuKixx.com) if you are under thirteen (13) years of age. To use or engage with the Platform being between the ages of thirteen (13) and eighteen (18) years of age, you must have your parent’s or legal guardian’s permission to do so. To use or engage with the Platform, you acknowledging and agreeing that you are not under the age of thirteen (13) years, are between the ages of thirteen (13) and eighteen (18), and have your parent’s or legal guardian’s permission to use or engage with the Platform, or are of adult age in your jurisdiction. By using or engaging with the Platform, you also acknowledge and agree that you are permitted by your jurisdiction’s Applicable Law to use and/or engage with the Platform.

 

 

Prohibited Content:

You acknowledge and agree to not send any prohibited content over the Platform. Prohibited content includes information and imagery that may be considered:

  • Defamatory, fraudulent, harassing, libelous, scandalous, threatening, or that which may indicate stalking

 

 

Regarding Personal Information:

When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information. We generally collect data such as IP address, time zone, web browser, and any cookies that are installed on your viewing device. 

 

When you visit NuKixx.com, we automatically collect certain information about your device, including information about: 

  1. Location information when you visit our Site or use our Applications, including location information either provided by a mobile device interacting with one of our Site or Applications, or associated with your IP address, where we are permitted by law to process this information.

  2. Personal information you provide when you request information or purchase products or services from us, whether on our Platform or through our Applications, including your postal address, telephone number and payment information.

  3. Personal Information you provide in public forums on our Site and Applications such as quotes, comments, photographs, videos, or other digital media.

  4. Usage, viewing and technical data, including your device identifier or IP address, when you visit our Site, use our Applications on third-party sites or platforms, or open emails we send.

  2. Log files track actions occurring on NuKixx.com, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.

The information you provide may be separately collected by the third-party site or platform. Information that any third-party site or platform collects is subject to that third party’s privacy policy. Privacy choices you have made on the third-party site or platform will not apply to our use of the information we have collected on our Platform.

Regarding Order Information:

When purchasing or attempting to make a purchase through NuKixx.com, it is necessary to collect certain information from you, including your:

  1. Billing address

  2. Email address

  3. Shipping address 

  4. Name

  5. Payment information (including credit card numbers)

  6. Phone number

 

This information can be generally categorized as “Order Information.” The website uses cookies to help keep track of items you put into your shopping cart including when you have abandoned your cart.

 

Order & Personal Information Usage:

Order Information is used to fulfill any orders placed through NuKixx.com including: 

Arranging for shipping, processing your payment information, and providing you with invoices and/or order confirmations).  

 

Order Information may also be used to:

  1. Communicate with you

  2. Provide you with information or advertising relating to our products or services

  3. Screen our orders for potential risk or fraud

  4. Use Device Information that we collect to help us screen for potential risk and fraud (IP address is a primary focus), and additionally to improve and optimize our site via generating analytics about customer browsing and interactions with NuKixx.com and our marketing and advertising services.

 

Who Else Can See Your Personal Information:

NuKixx will maintain a record of your Order Information until you request to delete this information.

Behavioral Advertising:

As previously mentioned NuKixx will use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. If we learn that personal information from children under the age of 16 has been collected without verifiable parental consent, then we will take the appropriate steps to delete this information. If you are a parent or guardian and discover that your child under 16 years of age has obtained an account on our Site or through our Applications, please alert us at info@nukixx.com so that we can delete your child’s personal information from our systems.

How we collect information:

We may collect personal information you provide to us when you request products, services or information from us, register with us, participate in public forums or other activities on our Site and Applications, respond to consumer surveys, or otherwise interact with us. Please keep in mind that when you provide information to us on a third-party site or platform, the information you provide may be separately collected by the third-party site or platform. Privacy choices you have made on the third-party site or platform will not apply to our use of the information we have collected directly through our Applications.

We may collect information through technology, such as cookies, Flash cookies and Web beacons, including when you visit our Site and Applications or use our applications on third-party sites or platforms. Most web browsers automatically accept cookies, but you can generally change your browser’s settings to display a warning before accepting a cookie, or to block all cookies. Please refer back to the previous sections for more information regarding cookies.

Do Not Track:

NuKixx USA LLC does not alter NuKixx.com’s data collection and use practices when we see a Do Not Track signal from your browser.

Access to Specific Information and Data Portability Rights:

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

  1. The categories of personal information we collected about you.

  2. The categories of sources for the personal information we collected about you.

  3. Our business or commercial purpose for collecting or selling that personal information.

  4. The categories of third parties with whom we share that personal information.

  5. The specific pieces of personal information we collected about you (also called a data portability request).

  6. If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:

  7. sales, identifying the personal information categories that each category of recipient purchased; and

  8. disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.

Deletion Request Rights:

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  9. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Exercising Access, Data Portability, and Deletion Rights:

To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by sending us a message on our website. Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

 

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  1. Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.

  2. Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.
